- preventing unauthorised access to the Mobile Application and ensuring the security of the Device and your access to the Mobile Application. In the event that the security of your Device or access to the Mobile Application are compromised, you shall inform the development or property management immediately;
- providing truthful and accurate information when registering for an account to use the Mobile Application;
- complying with all applicable laws and regulations in connection with the use of this Mobile Application, as well as any rules, policies and guidelines relating to this Mobile Application issued by Panasonic;
- not to copy, edit, vary, reproduce, retain, publish, display, distribute, store, transmit, commercially exploit or disseminate in any form or use the information you access, download and submit through this Mobile Application;
- not to attempt to gain unauthorised access to the Mobile Application or any networks, servers or computer systems connected to the Mobile Application, including but not limited to the introduction of viruses, disabling code, time bomb, trap door, or similarly destructive programme, information, command or code;
- not to modify, adapt, translate or reverse engineer any part of the Mobile Application or re-format or frame any portion of the pages comprising the Mobile Application;
- not to modify, adapt, translate or reverse engineer any part of the Mobile Application or re-format or frame any portion of the pages comprising the Mobile Application;
- not to rent, lease, sub-license, loan, provide, or otherwise make available, the Mobile Application in any form, in whole or in part to any third parties;
- not to submit or transmit any material that is defamatory, offensive or otherwise objectionable in relation to your use of the Mobile Application;
- not to share your password or log-in details with any third party;
- not to use another user’s account, whether with or without his/her permission; and
- obtaining the owner’s permission if you are downloading the Mobile Application onto a Device not owned by you, of which you will be responsible for complying with these Terms and Conditions of Use.

- REGISTRATION FOR ACCOUNT AND USE OF MOBILE APPLICATION
- 1 Upon submitting an application to register for an account to use the Mobile Application, the development or property management will verify your details before approving your registration and allowing you access to the Mobile Application.
- 2 Panasonic may record, use and process the International Mobile Equipment Identity (IMEI) number of your Device, your contact details and other personal particulars for the purpose of registration and security administration of the Mobile Application in accordance with these Terms and Conditions of Use.
- 3 Certain functions of the Mobile Application may make use of location data sent from the Devices. You can turn off this functionality at any time by turning off the location services settings for the Mobile Application on the Device. If you use the Mobile Application, you consent to us and our affiliates’ transmission, collection, retention, maintenance, processing and use of your location data and queries to provide and improve location-based services. You may stop us collecting such data at any time by turning off the location services settings on your Device. You may not be able to utilise the Mobile Application or all functions when location services settings are turned off.
- UPDATE TO THE MOBILE APPLICATION
- 1 From time to time we may automatically update the Mobile Application to improve performance, enhance functionality, reflect changes to the operating system or address security issues. Alternatively, we may ask you to update the Mobile Application for these reasons.
- 2 If you choose not to install such updates or if you opt out of automatic updates, you may not be able to continue using the Mobile Application.
- 3 The Mobile Application will always work with the current or previous version of the operating system as (it may be updated from time to time) and match the description of it provided to you when you downloaded it.
- USE OF VOICE CONTROL FUNCTION
- 1 The Solution incorporates voice control functions in connection with Amazon Alexa or Google Assistant services (“Voice Control Function”). This Clause applies to your use of the Voice Control Function, and not to your use of Amazon Alexa or Google Assistant generally, which are third party services and subject to terms and conditions set forth by Amazon or Google, respectively.
- 2 The Voice Control Function may be used by you or by other people in your home. If other people in your home want to use the Voice Control Function, you must tell them of these Terms and Conditions of Use and obtain their acceptance before they use the Voice Control Function.
- 3 You are, at your own cost and expense, responsible for setting up, installing and maintaining the internet environment necessary, including any Amazon or Google device and/or terminal in order to use the Voice Control Function.
- 4 There may be situations where you have to agree to other terms for your usage of the whole or a part of the Voice Control Function, for example, terms and conditions applicable to your use of Amazon Alexa or Google Home (the “Rules”). If this is the case, you may use the Voice Control Function only after you have agreed to the Rules. If there is any conflict between these Terms and Conditions of Use and the Rules, the Rules will prevail unless otherwise agreed by you and us.
- 5 When you upload, share, or make public any content, you will be responsible for all that content and you must make sure that you own the right to do so.
- 6 We may temporarily stop the Voice Control Function without telling you in advance where: (a) the service of Amazon Alexa or Google Assistant is suspended for any reason; or (b) we deem it necessary to temporarily stop the Voice Control Function for managerial, operational, or technical reasons.
- 7 We may change, add, suspend or terminate the whole or a part of the Voice Control Function and its contents, and may make changes or additions to usage conditions of the Voice Control Function for the purpose of, including, but not limited to, Voice Control Function-related maintenance or construction work by making a reasonable prior announcement on the Mobile Application.
- INTELLECTUAL PROPERTY RIGHTS
- 1 All content, information, data, videos, photographs, illustrations, artwork, images, sounds, and other graphic materials, and names, logos and trade marks (“Intellectual Property”) available or accessed from the Mobile Application or submitted by you through this Mobile Application belong to Panasonic or any other right holders from whom we have obtained licenses, and are protected by relevant intellectual property laws. You must not edit, copy, reproduce, retransmit, distribute, disseminate, sell, publish, broadcast or circulate any Intellectual Property, whether in whole or in part, unless permitted under these Terms and Conditions of Use. Nothing in these Terms and Conditions of Use should be construed as granting any license or right to use any Intellectual Property.
- 2 We need to use content and information that you upload or otherwise submit to us in order to provide the Mobile Application. In this regard, you agree to grant us a worldwide, assignable, irrevocable, royalty-free license, with the right to sub-license, to use all content and information provided by you to us for the purposes of our providing any services to you.
- LIABILITIES & INDEMNITY
- 1 This Mobile Application is provided on an “as is” basis. To the maximum extent permitted by law, Panasonic disclaims (a) all liability whatsoever, whether arising in contract, tort (including negligence) or otherwise in relation to your download, access or use of this Mobile Application, and (b) all implied warranties, terms and conditions relating to this Mobile Application, including but not limited to any warranty, term or condition as to accuracy, completeness, satisfactory quality, performance, fitness for purpose or any special purpose, availability, non-infringement, information accuracy and interoperability. In particular, but without prejudice to the foregoing, Panasonic accepts no responsibility for any technical failure, interruption or errors in the internet, the Voice Control Function and/or this Mobile Application, damage or malfunction to the Device (including but not limited to damage or corruption of your other mobile application software, files and data) as well as any personal injury as a result of or relating to the download or use of this Mobile Application.
- 2 You agree to indemnify Panasonic, including our directors, employees, agents and representatives in full and on demand from and against any claim, loss, expense, liability or damages suffered or incurred directly or indirectly as a result of your use of this Mobile Application otherwise than in accordance with these Terms and Conditions of Use.
- THIRD-PARTY LINKS AND PRODUCTS ON OUR SERVICES
- 1 The Mobile Application may provide links to other websites hosted by third parties (“Linked Sites”). We do not have the obligation to monitor the content on the Linked Sites and have no discretion to alter, update or control the content on the Linked Sites. Our provision of hyperlink to Linked Sites shall not be construed as an endorsement, authorisation, sponsorship, or affiliation with respect to such websites, their owners, or their providers.
- 2 The Linked Sites may contain rules and regulations, privacy provisions, confidentiality provisions, transmission of personal data provisions, and other provisions which differ from the provisions provided here and our Privacy Policy. If you link to otherwise visit any of these Linked Sites, please review their respective terms of use, privacy statements, notices and policies.
- TRANSMISSION OF PERSONAL DATA
- 1 You have read our Privacy Policy which sets out the terms that specifically govern the collection, use, retention and disclosure of your personal data and any other third parties’ personal data that you submit through the Mobile Application. Accordingly, you have agreed to the terms of our Privacy Policy, given your consent and/or obtained necessary consent from relevant third parties to the collection and transfer of these personal data according to the terms of our Privacy Policy.
- CESSATION, TERMINATION & SUSPENSION OF USE
- 1 You must not use this Mobile Application and will promptly delete this Mobile Application from your Device at any time upon our request, when you sell the Device, or no longer residing at the development or working at the commercial property (upon which the development or property management will also delete your account from its backend system). Notwithstanding the foregoing, Panasonic reserves the right to suspend, terminate or disable your use of this Mobile Application from your Device at our sole discretion with or without notice at any time and without any liability or responsibility to you.
- 2 Upon any termination, (a) the rights and licenses granted to you in these Terms and Conditions of Use will end; (b) you must stop using this Mobile Application, and (c) (if needed) delete this Mobile Application from your Device.
- THIRD PARTY APPLICATION STORES
- 1 The ways in which you can use the Mobile Application may also be controlled by the rules and policies of the application stores from which you download this Mobile Application, such as Apple Store or Google Play. The rules and policies of these application stores will apply instead of these Terms and Conditions of Use where there are differences.
- GENERAL
- 1 Nothing contained in these Terms and Conditions of Use shall be construed as creating an employment or agency relationship between Panasonic and you.
- 2 You shall not assign, transfer, license or sub-contract your rights or obligations under these Terms and Conditions of Use.
- 3 If any of these Terms and Conditions of Use is determined to be legally invalid or unenforceable, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of the Terms and Conditions of Use shall continue in effect.
- 4 Any failure to insist upon or enforce strict performance of any provision of these Terms and Conditions of Use shall not be construed as a waiver of any provision or right.
- 5 Unless otherwise expressly stated, nothing in these Terms and Conditions of Use shall create any rights or any other benefits in favour of any person or entity.
- 6 These Terms and Conditions of Use are governed by and construed in accordance with the laws of the Republic of Singapore without reference to its conflicts of law rules and, you agree to submit to the exclusive jurisdiction of the Courts of the Republic of Singapore.
- 7 No party shall be liable for any failure to perform its obligations under these Terms and Conditions of Use if the failure results from a Force Majeure Event (defined below), provided always that whenever possible, the affected party will resume that obligation as soon as the Force Majeure Event occasioning the failure ceases or abates. A “Force Majeure Event” is an event which is a circumstance or event beyond the reasonable control of a party which affects the general public in that party’s country or in the territory, and which results in the party being unable to observe or perform on time an obligation under these Terms and Conditions of Use.
- 8 We reserve the right to update or revise these Terms and Conditions of Use from time to time without notice to you.
